(hereinafter the "Provider")
§ 1 Scope
The business relationship between the Provider and the customer is governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Deviating terms of the customer are not recognised unless the Provider expressly agrees to their validity in writing.
§ 2 Conclusion of contract
The customer can select products from the Provider's range and collect them in a so-called shopping cart via the corresponding button. By clicking the order button ("Pay now" or similar), the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the customer can change and view the data at any time. The Provider then sends the customer an automatic order confirmation by e-mail, in which the order is listed again. The purchase contract is concluded upon receipt of this order confirmation.
The contract language is English. The contract text (order data and these GTC) is sent to the customer by e-mail on a durable medium and can be viewed in the customer account where one has been created.
§ 3 Pre-orders, delivery, availability, payment and customs
Pre-orders. The products in this shop are offered as a limited pre-order ("Pre-Order Vault"). Orders can be placed only during the pre-order window stated on the product page (9 to 26 September 2026). The goods are produced after the pre-order window closes and are dispatched within four weeks after that date. The expected dispatch period is stated on the product page and in the order confirmation. The statutory right of withdrawal remains unaffected.
Delivery times otherwise stated by the Provider are calculated from the time of the order confirmation, provided payment has been made. Should a product be temporarily unavailable, the Provider will inform the customer immediately. In the event of permanent unavailability, the Provider may withdraw from the contract; any payments already made will be refunded without delay.
The available delivery countries (currently the countries of Europe listed at checkout and the United States) and payment methods are shown in the shop. Payment methods are in particular credit card, PayPal, Apple Pay, Google Pay and Klarna. Payment is due immediately upon conclusion of the contract.
For deliveries outside the European Union (for example to the United States), additional customs duties, import taxes and fees may be incurred, which are to be borne by the customer unless expressly stated otherwise at checkout. For consumers, the statutory provisions on the passing of the transport risk apply.
§ 4 Retention of title
The delivered goods remain the property of the Provider until full payment has been made.
§ 5 Prices and shipping costs
All prices stated in the shop are total prices and include the applicable statutory value-added tax. Shipping costs are shown before the order is completed. In the event of a withdrawal, the customer bears the direct costs of returning the goods.
§ 6 Warranty for defects
The Provider is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code (BGB). For business customers, the limitation period for claims for defects is twelve months from delivery.
§ 7 Liability
Claims for damages by the customer are excluded. This does not apply to claims for damages arising from injury to life, body or health, from the breach of essential contractual obligations (cardinal obligations), or to liability for other damages based on an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract.
In the event of a breach of essential contractual obligations, the Provider is only liable for the foreseeable damage typical for the contract if this was caused by simple negligence, unless the customer's claims are based on injury to life, body or health. These restrictions also apply in favour of the Provider's legal representatives and vicarious agents. Liability under the German Product Liability Act remains unaffected.
§ 8 Data protection
The Provider processes the customer's personal data for the purpose of using the online shop and processing orders. Information on data processing can be found in the separate Privacy Policy.
§ 9 Final provisions
Contracts between the Provider and the customer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the registered office of the Provider. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by the relevant statutory provision.
Consumer dispute resolution
Spreemerch UG (haftungsbeschränkt) is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
